As of 2018, the non-economic damages cap in a Maryland medical malpractice case is $800,000, with $15,000 added per year for lawsuits filed beyond 2018. In 2019, the cap for wrongful death cases made by two or more beneficiaries was raised to just over $1,018,500. The cap is based on the year of injury or death, and applies as long as the case is filed within Maryland’s statute of limitations . There is no medical malpractice cap on economic damages.
