As of 2018, the non-economic damages cap in a Maryland medical malpractice case is $800,000, with $15,000 added per year for lawsuits filed beyond 2018. In 2019, the cap for wrongful death cases made by two or more beneficiaries was raised to just over $1,018,500. The cap is based on the year of injury or death, and applies as long as the case is filed within Maryland’s statute of limitations. There is no medical malpractice cap on economic damages.
